Who owns unadopted roads




















Obtaining a Highways Search, in addition to the Local Authority Search, should provide more detail as to if the highway is adopted. An unadopted roads condition will, of course, vary and depends on how well maintained it was.

The worst roads may have poor drainage, potholes, be unsurfaced and have no street lighting. This can leave the property owners fronting such highways with the risk of having to spend large amounts or collectively fund the rectifying of any such issues.

What has become more common is finding the actual owner of the unadopted road. If the title is unregistered, finding the owner can be virtually impossible. However, if the ownership is established, it is possible to request the Local Authority to adopt the highway. Avatars by Sterling Adventures.

An unadopted street may be a highway over which all people have a right to pass and repass a public highway which is privately maintained , or a private street over which some people have a private right of access either by right of ownership, agreement, grant or long usage.

Whilst a frontager to a highway has a right of access to a highway, an owner of land adjacent to a private road does not have an automatic right of access to it. Residents often think that as they both own and pay for the upkeep of their unadopted street they have a right to obstruct it as they choose, eg by putting a gate across the street. However, it is just as much an offence to obstruct an unadopted highway as any other highway.
